Who Is Suing: Two Different Plaintiffs

The CarePoint Litigation Trust. Province Fiduciary Services, LLC was appointed Litigation Trustee under CarePoint’s plan, which took effect on May 22, 2025. It filed most of the cases above, through Akerman LLP and the Law Offices of Mitchell J. Malzberg, LLC, seeking payments made by the hospital and management entities.

The Practice Group Debtors. Garden State Healthcare Associates, LLC and New Jersey Medical and Health Associates, LLC (d/b/a CarePoint Health Medical Group) were not covered by the confirmed plan and filed their own lawsuits for payments made by the physician practice entities.

At least three defendants, including CVS Caremark and Horizon Blue Cross Blue Shield of New Jersey, appear to have been sued by both plaintiffs. A company sued by both plaintiffs faces two separate lawsuits and must respond to each.

The CarePoint Case in Brief

CarePoint operated Bayonne Medical Center, Christ Hospital in Jersey City and Hoboken University Medical Center, with related management and physician entities. The debtors filed Chapter 11 in Delaware on November 3, 2024, and the cases are jointly administered before Judge J. Kate Stickles. The plan was confirmed on April 17, 2025.

Why the Lawsuits Were Filed Now

Preference lawsuits generally must be filed within two years after the bankruptcy filing. CarePoint filed on November 3, 2024, which is why this wave was filed in the final days before November 2026. According to at least one complaint, demand letters went out around August 17, 2026.

What the Trust’s Complaints Say About Defenses

The trust’s complaints state that it reviewed the debtors’ books and identified some potential subsequent new value for each defendant. They also say that figure is based on invoice dates in the debtors’ records, that new value usually depends on shipping or service dates, and that the figure may change. The complaints also discuss the ordinary course of business defense but say much of that information is in the defendant’s hands.

In other words, the trust’s own complaint acknowledges that a defendant’s records can change the numbers. Defendants should have their defenses calculated from their own records, including:

  • Dates of service for staffing agencies, physicians and contractors
  • Shipping and delivery dates for medical device and supply companies
  • Payment history and terms for ordinary course
  • Prepayment and same-time exchange arrangements

Healthcare-Specific Issues

Staffing agencies and physicians. Agencies and doctors were often paid weekly or by pay period. Services performed after a payment can count as new value, and steady payment patterns can support ordinary course.

Medical device and implant companies. Consignment, bill-only and case-by-case implant billing can affect when a debt arose and when new value was provided.

Payors and insurers. Several health insurers and benefits companies were named. Payments for premiums, administrative fees or reimbursement adjustments raise different issues than vendor payments.

Multiple hospitals. Exhibit A shows which CarePoint entity made each payment. The trust also pleads, in the alternative, that payments by one entity on another entity’s bill may be fraudulent transfers, so the paying entity matters.

What to Do If You Are on the List

  1. Find your summons and note the date it was issued.
  2. Confirm which plaintiff sued you and which CarePoint entity paid you.
  3. Preserve contracts, invoices, timesheets, delivery records and payment records from mid-2024 through November 2024.
  4. Contact a Delaware-admitted preference defense attorney before responding, paying or signing anything.

Frequently Asked Questions

How do I know if I was sued in the CarePoint bankruptcy?
Check the list above and your mail for a summons and complaint. Many defendants also received a demand letter in August 2026.

Why are doctors and nursing agencies being sued?
Preference law applies to anyone paid on an older debt in the 90 days before bankruptcy, including physicians and staffing agencies.

What does the new value amount in the complaint mean?
It is the trust’s preliminary estimate from the debtors’ records, based on invoice dates. The complaint itself says it is subject to adjustment.

Will more CarePoint lawsuits be filed?
The two-year filing deadline generally ran in early November 2026, so most suits should already be on file, but defendants with tolling agreements could still be sued.
